All Goods made available through the Store, as well as all content in the Store, are subject to copyright and
are subject to legal protection. Their use and distribution without the consent of the Store owner is prohibited.

is run by Julia Sotkiewicz, hereinafter referred to as the „Service Provider”.
Company name – Julia Sotkiewicz, the company is located at Bayswater Mill, Oxford, United Kingdom.

The exclusive right to run the Store belongs to the entity indicated above, which is
the Owner, Seller and Administrator of the Store. In case of any questions,

DEFINITIONS :

  1. Regulations – these Regulations together with annexes, providing information on the obligations and
    rights of the Parties to the Agreement,
  2. Company – (hereinafter referred to in this Agreement as „We”, „Us” or „Our”) means Julia Sotkiewicz,
  3. Country – refers to: United Kingdom,
  4. Parties to the Agreement – ​​Customer and Seller,
  5. Distance contract – a contract concluded with the Client as part of an organized
    distance contracting system, without the simultaneous physical presence of the Parties, with
    the exclusive use of one or more means of distance communication
    up to and including the moment of conclusion of the contract,
  6. Shop – internet service available under the internet domain https://shop.juliasotkiewicz.com/, which is an integral part of the home page at https://juliasotkiewicz.com/
    operating under the principles specified in the Regulations, which consists of graphic elements,
    functionalities enabling the provision of electronic Services to Customers;
    through which it is possible to provide services specified in the Regulations;
  7. Customer – a person using the Store: a natural person who is over 18 years of age and has full
    legal capacity, as well as a legal person and an organizational unit without legal personality
    to which the law grants legal capacity;
  8. Consumer – a natural person purchasing products or services through the Store for
    purposes not directly related to his or her business or professional activity;
  9. Payment method – the form of payment for the ordered product/goods or service, selected by the Customer
    when placing the order, offered by the Website or as a result of individual arrangements with
    the Website in a form other than the forms of payment presented on the website;
  10. Delivery address – address or addresses indicated by the Seller as addresses for submitting
    specific declarations, being correspondence addresses;
  11. Order Form – a technical system located in the Store that enables
    the Customer to place an order using the available form fields;
  12. Newsletter – Electronic service consisting in providing Customers with information to
    the e-mail address provided by the Customer, with the Customer’s consent, including: actions undertaken by
    the Service Provider, including promotions and new products in the Store, This service is provided free of charge for an indefinite period.

1. GENERAL
1.1 The subject of the Store’s activity is the sale of products in the territory of the United Kingdom and abroad.
Information about products in the Store, i.e. descriptions and prices, constitute an invitation to conclude a sales agreement
in accordance with the terms of the Regulations.

1.2 These Terms and Conditions apply when you as a Customer (hereinafter referred to as the “Customer” or “you”) place an order via
www.shop.juliasotkiewicz.com and related sites, (hereinafter referred to as the „Website” juliasotkiewicz.com ). With this agreement, you also confirm that you have read and accepted these Terms and Conditions and our Privacy Policy  .

1.3 All Goods made available through the Store, as well as all content in the Store, are subject to copyright and
are subject to legal protection. Their use and distribution without the consent of the Store owner is prohibited.

1.4 I do not accept returns on all products in the Portals and Glass Mandalas category, unless the item is damaged or defective.

1.5 Returns are only accepted for products from the Bag category.

2. PLACING AND FULFILLING ORDERS
2.1 The Customer may place electronic Orders for Goods presented in the Store 24 hours a day,
provided that the Order is fulfilled by the Service Provider on working days (Monday to Friday).
Goods are sent by the Seller within 15 working days, unless a different time is clearly specified in the product description when the customer places the order.

2.2 To place an order, select the Goods in the Store, add them to the „Basket” using the appropriate button and continue the ordering procedure by selecting the appropriate options (delivery and payment method).

2.3 The condition for placing an order is to complete all required data necessary
for the performance of the contract in the order form.

2.4 The customer’s approval of the order by clicking the „Buy and pay” button (or another button with the same wording) means:
submitting to the Seller an offer to purchase the Goods in accordance with the options selected in the order and in accordance with these Regulations,
accepting the obligation to pay the price of the Goods and the costs of their delivery.

2.5 The sales agreement (hereinafter „Agreement”) is concluded at the time of acceptance of the order by the Seller
for execution (acceptance of the customer’s offer), about which the Seller informs by e-mail
confirming acceptance of the order for execution.

2.6 Submitting the declarations indicated in the Order forms available in the Store is voluntary,
however, failure to submit the declarations marked with „*” (asterisk) prevents the effective placement of the Order
in the Store, about which the Customer is informed by displaying a message when placing the Order.

2.7 The Service Provider may send information necessary to complete and process the Order to the e-mail address provided by the Customer in the Order form, and the Customer is therefore obliged to provide an e-mail address to which he or she is authorized and has active access.

2.8 The Seller reserves the right to suspend the execution of the order in a situation
where the customer has provided false data or when such data raises reasonable doubts as to its correctness.
In such a case, the Seller (if possible) will attempt to contact the customer
to verify the truthfulness of the data provided.

2.9 The Store shall not be liable for non-delivery of the order or delay in its delivery resulting
from the customer providing an incomplete/incorrect delivery address or failure to provide other
data necessary to complete the order.

2.10 If it is not possible to fulfill the order of the Goods (in whole or in part), the Seller will inform
the customer about this – then the Agreement is not concluded. The Seller will also inform the customer about
the existing possibilities of another method of fulfilling the order, e.g. partial fulfillment of the order
or waiting for the Seller to replenish the stock.
If the order has been previously paid for by the customer and it is not possible to fulfill,
the Seller will immediately return the payments made to the customer (according to the scope of the order cancellation).

2.11 The order is considered to be fulfilled at the moment of sending
the shipment to the customer (entrusting the shipment to the carrier engaged in transport).
The exact actual delivery date of the shipment is specified by the carrier.

2.12 The Customer has the right to use the Goods or services under the terms and conditions set out in the Regulations,
exclusively for his/her own personal use and may not make them available to third parties, and in particular
the Customer is not entitled to distribute them or make their derivative works available in whole or in
part for any purpose, to reproduce them for any purpose other than for his/her own personal use
or use in accordance with the law, unless otherwise stipulated in the mandatory provisions of law.

3. PAYMENTS
3.1 The prices of the website are given in British pounds (GBP) and are net amounts, i.e. they excluding VAT.

3.2 The customer can see prices, and choose to pay in the following currencies:
EUR – €
GBP – £
USD – $
PLN – zł

3.3 When choosing to pay in a different currency, please remember about currency conversion costs, which are beyond my control.


3.4 The store offers online payment, via the PayPal payment system – Account or credit card. Available worldwide.

3.5 All payments are encrypted and processed according to the highest security standards.

3.6 The condition for the commencement of the Order execution by the Service Provider is the payment of the Price by the Customer.
Failure to make payment by the Customer during the Order placement procedure will result in the cancellation of the Order.


3.7 Delivery costs are covered by the Customer in accordance with the choice of delivery and payment method made when placing the Order.

3.8 The cost of delivery of Goods is given separately in the Store’s shopping cart, depending on the delivery method chosen
by the customer.

3.9. The Customer is responsible for paying any customs duties to the customs office or equivalent authority in the country to which the Product(s) will ultimately be delivered.

3.10 The customer places an order according to the prices in force at the time of placing the order.
The Service reserves the right to change prices. This provision does not apply to orders already in progress.

4.SHIPPING

4.1 Small and medium items are sent fully insured and tracked via Royal Mail/Parcelforce.
Postage is calculated at checkout.
Larger pieces will be packed and sent via a specialist courier who I will fully arrange for you.
Postage for large pieces is worked out separately.
Please contact us for a quote before ordering.

​4.2 SHIPPING TIMES
UK (usually 2-5 days after dispatch)
Europe (usually 1-2 weeks after dispatch)
Rest of the world (usually 1-3 weeks after dispatch)

4.5 There may be postal delays which are out of my control.


4.6 Now the UK has left the EU, your parcel may be subject to import duties and taxes which are applied once the delivery reaches the specified destination. Please check your own country’s policies on this before you purchase. Please note that I have no control over these charges. I will NOT refund costs I have incurred if parcels are returned to me.
Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. I will not be liable for any breach by you of any such laws.

5. LOST, DAMAGED OR UN-COLLECTED PACKAGES

5.1 All parcels are insured to full content value. Very rarely parcels do get lost/damaged.
If your parcel has not arrived in 30 days, please contact me and I will investigate. 

5.2 If you were not at the specified delivery address when the delivery was attempted by the courier, it is your responsibility to collect from the local post office/depot in the time stated.

5.3 If a parcel is returned to me and you wish me to resend, you will need to pay for postage again. I will then resend when payment has been received.

5.4 Due to the nature of my work and all items being handmade, please appreciate any replacement piece will attract a waiting time. 

6. WARRANTY AND COMPLAINTS

6.1 All complaints related to the provision of Services via the Store and
questions regarding the use of the Store should be sent to the following e-mail address: julia@juliasotkiewicz.com .

6.2 The Customer must make a complaint of a defective Product to Julia Sotkiewicz within a reasonable time after the defect was discovered. If the complaint is made within two (2) months after the defect was discovered it is always made on due date. After two (2) years the Customer has lost the his/her right to make a complaint, provided that no warranty states otherwise. 

6.3 The right to make a complaint applies to products which are defective in accordance to applicable consumer protection regulations. Any Customer who wishes to assert the right to file a complaint for any product ordered, shall contact Julia Sotkiewicz, as soon as possible after discovering the defect, via e-mail to julia@juliasotkiewicz.com .

6.4 A properly filed complaint should at least include
the Customer’s designation (name, surname, address, e-mail address,
contact telephone number), description of the product being complained about. In a situation where the data or
information provided in the complaint requires supplementation, the Service Provider asks the person
filing the complaint to supplement it before considering the complaint. The time for providing additional
explanations by the Store extends the complaint consideration period.



6.5 The Store will respond to the Consumer’s notification within 14 (fourteen) days.
Otherwise, it is considered that the Seller has considered
the Consumer’s statement or request as justified. If the Customer who is a Consumer has requested an exchange of the service
or has made a statement about a price reduction, specifying the amount by which the price is to be reduced, and
the Service has not responded to this request within fourteen days, it is considered that the Store has considered this request
as justified.

7. RETURNS , WITHDRAWALS AND EXCHANGES

7.1 The Seller is obliged to deliver to the customer Goods in accordance with the Agreement.
If the Goods are not in accordance with the agreement, the Consumer may request their repair or replacement.

7.2 Julia Sotkiewicz does not offer the right of return or exchange for orders for Goods from the Portals and Glass Mandalas categories.

7.3 When purchasing products from the Bag category on the Shop Website, the Customer has a 14-day withdrawal period. This means that the Customer has the right to cancel a purchase from the above category by notifying Julia Sotkiewicz within 14 days of receiving the ordered product by the Customer or their representative (withdrawal period). 

7.4 If the Customer exercises the right to withdraw from the contract (in the case of point 2), the Customer is responsible for the condition of the product upon receipt of the product and during return shipping. The product must be returned within 14 days from the date of notification of withdrawal from the contract to Julia Sotkiewicz. The product must be sent back in its original condition, well packed, preferably in its original packaging. If the condition of the product changes in any way, the Customer may be charged additional costs. The Customer should register his return via e-mail to: julia@juliasotkiewicz.com .

7.5 The customer should provide their name, address and other important information in the message, e.g. order number, product name. After registration, the customer will receive an e-mail containing instructions and address details for returning the package. The customer should not attempt a return before contacting Julia Sotkiewicz.

7.6 The customer bears the shipping risk and shipping costs for the return. Please note that the return must be sent as a trackable shipment. Julia Sotkiewicz suggests that the customer retain the tracking number and proof of postage until Julia Sotkiewicz receives the return. 

7.7 Once the return has reached Julia Sotkiewicz and has been processed, Julia Sotkiewicz will issue a refund to the customer. All refunds will be issued to the same payment method that the customer used to purchase the product(s).

8.  TECHNICAL REQUIREMENTS AND COOKIE INFORMATION


8.1Recommended technical requirements for cooperation with the IT system are: computer with
Internet access, access to e-mail, Internet browser.

8.2 The Store uses cookie technology.


8.3 Cookies (also known as „cookies”) are computer data, in particular text files, which are stored in the User’s end device and are intended for using the Store’s website.

8.4 The files indicated in point 8.3 enable the User’s device to be recognised and
the website to be displayed accordingly, tailored to their individual preferences.

8.5 The Store uses various types of cookies, which are:
– Persistent cookies , which are stored on the end device for the period
specified in the parameters of a given file or until
the User deletes the cookies themselves.
– Temporary cookies , which are deleted at
the end of the so-called session, i.e. logging out of the website, leaving the website
or closing the web browser that displays the website.
– Own cookies , which are cookies placed on the website by the owner.
– External cookies , which are cookies placed on the website by external entities, e.g. to
conduct anonymous statistics by Google Analytics.

8.6 To change the settings of the Cookie Policy, you must change your browser settings.

9. SERVICE AND PRICE CHANGES

9.1  Julia Sotkiewicz may make changes to the Terms of Service from time to time. When such changes are made, Julia Sotkiewicz will make a new copy of the Terms of Service available on its website.

9. 2 Your continued use of our website following any changes to these Terms and Conditions constitutes acceptance of those changes.

9.3 Prices for our products are subject to change without notice.
We reserve the right to modify or discontinue the Service (or any part or content thereof) at any time without notice.
We shall not be liable to you or to any third party for any modification, price change,
suspension or discontinuance of the Service.

9.4 We have made every effort to display as accurately as possible the colours and images of our products
that appear in the store. We cannot guarantee that your computer monitor’s display of colours will be accurate.

9.5  We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on an individual basis.

9.6 We reserve the right to limit the quantities of products or services we offer.

9.7 All descriptions of products or product pricing are subject to change at any time without notice,
at our sole discretion.

9.8 We reserve the right to discontinue any product at any time.

9.9 Any offer for any product or service made on this site is void where prohibited.

9.10 We undertake no obligation to update, amend or clarify information in the Store or on any
related website, including, without limitation, pricing information, except as required
by law. No specified update or refresh date applied in the Store or on any
related website should be taken to indicate that all information in the Store
or on any related website has been modified or updated.


9.11 Occasionally there may be information on our site or in the Service that contains typographical errors,
inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers,
product shipping charges, transit times and availability. We reserve the right to correct any errors,
inaccuracies or omissions, and to change or update information or cancel orders if
any information in the Service or on any related website is inaccurate at any
time without prior notice (including after you have submitted your order).

9.12 We do not guarantee, represent or warrant that your use of our service will be uninterrupted,
timely, secure or error-free.

9. 13 You expressly agree that your use of the Service or inability to
use the Service is at your own risk.

10. NEWSLETTER

10.1 The Service Provider provides a Newsletter subscription service, within which the Service Provider sends information in the form of an electronic letter (e-mail) via e-mail to the e-mail address provided by the Customer, with their consent. The Newsletter service is provided free of charge for an indefinite period. The Service Provider decides on the frequency of sending the Newsletter.

10.2 Consent to sending the Newsletter is voluntary and the Customer may withdraw consent at any time.

10.3 To order a Newsletter subscription, the Customer provides his/her e-mail address in the appropriate field in the form.

10.4 The Customer may unsubscribe from the Newsletter at any time by sending the Service Provider a statement of unsubscription from the Newsletter by e-mail or post.

10.5 The Service Provider may terminate the agreement regarding the provision of the Newsletter service at any time for important reasons.

11. FINAL PROVISIONS

11.1 The Service Provider reserves the right to make changes to the content in
the Store and to make any changes to the price list of products offered via
the Store.

11.2 he Service Provider shall not be liable for:
a) any damage caused by the Users’ infringement – ​​in connection with
the use of the Store – of the rights of third parties;


b) damages resulting from disruptions in the operation of the Store or its unavailability
caused by reasons beyond the control of the Service Provider or which occurred as a result of
events which the Service Provider was unable to prevent;


c) any other damage caused by the User’s failure to comply
with the provisions of these Regulations.

11.3 In the event of a dispute with the Seller, the Consumer has the opportunity to settle the matter amicably
through: mediation, or by contacting the appropriate consumer bodies such as Citizens Advice.
Additional information on out-of-court methods of dealing with complaints and pursuing claims
is also available on the website www.citizensadvice.org.uk ?

11.4 Julia Sotkiewicz shall be exempt from damages and other remedies if the performance of the contract is prevented or delayed by any circumstances beyond our control, e.g. extreme weather conditions, new/changed regulations, lack of permits, war, fire, flood, disruptions in the labor market, technical problems, sabotage, unfavorable transport, terrorist attacks, changed government orders, as well as delays in the provision of services by sub-suppliers due to the circumstances set out above. Julia Sotkiewicz will inform the Customer accordingly if such circumstances occur and if the situation lasts longer than six weeks, both the Customer and Julia Sotkiewicz shall be entitled to cancel the purchase with immediate effect.

11.5 We do not warrant that the quality of any products, services, information or other material purchased
or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
